1. Introduction
Acceptance of Terms: These Terms and Conditions (the “Terms”) govern your access to and use of MRCPro’s website and services. MRCPro (“we”, “us”, or “our”) is a cleaning and maintenance service provider registered as a Quebec corporation (Quebec Inc). By using our website, requesting a quote, or booking a service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or services.
Modification of Terms: MRCPro reserves the right to update or modify these Terms at any time. Any changes will be effective upon posting to our website. It is your responsibility to review the Terms periodically. Continued use of the website or our services after changes are posted constitutes acceptance of the revised Terms.
2. Services Offered
MRCPro provides professional cleaning and maintenance services for both commercial and residential clients in the Greater Montreal Area. Our offerings include general office and home cleaning, floor care, window cleaning, and routine property maintenance, among other standard cleaning tasks.
Service Limitations: Please note that our services are limited to non-hazardous cleaning and maintenance. We do not handle hazardous cleaning tasks, such as:
- Removal of toxic or chemical waste
- Biohazard cleanup (e.g., blood, bodily fluids, or infectious materials)
- Asbestos, mold, or other environmental hazard remediation
Any requests for services that involve hazardous conditions or materials will be declined, as they fall outside the scope of MRCPro’s offerings.
3. User Responsibilities
When you request a quote or book a service through our website or customer service, you agree to provide accurate, current, and complete information. This includes, but is not limited to, correct contact information, the address of the service location, the size and condition of the area to be cleaned, and any specific requirements or relevant details about the property.
Accurate Information: Providing accurate information is essential for MRCPro to give you a proper service estimate and prepare the appropriate resources. If the information you provide is incorrect or incomplete, the initial quote or booking may not reflect the actual scope of work needed.
On-Site Adjustments: All quotes provided (whether via the website, phone, or email) are estimates based on the details you supply. Final pricing will be confirmed after an on-site inspection by our team. If upon arrival our staff discovers conditions that differ from what was described (for example, a significantly larger area, extreme dirt or clutter not disclosed, lack of utilities, etc.), MRCPro reserves the right to adjust the service plan and pricing. Additional charges may apply to cover any extra work or resources required due to discrepancies between the provided information and the actual conditions. We will discuss any changes in scope or cost with you before proceeding whenever possible.
Access and Safety: You are responsible for ensuring that our team has safe and reasonable access to your property at the scheduled time. This includes arranging any necessary permissions for entry (for example, informing building security or ensuring someone is present to grant access), securing pets, and removing any obstacles or valuable fragile items from areas to be cleaned. If our team arrives and is unable to perform the work due to lack of access, safety concerns, or unforeseen conditions on-site (including undisclosed hazardous conditions), it may be treated as a late cancellation (and subject to fees as outlined in the cancellation policy below) or require rescheduling at your expense.
4. Payment & Cancellation Policies
When booking a service, MRCPro may require an initial deposit to confirm and hold your appointment. The deposit amount and payment method will be communicated to you during the booking process (for example, MRCPro may require a deposit equal to 50% of the estimated service fee). This deposit will be credited toward your total service cost.
Payment: Unless otherwise agreed, payment for services is due in accordance with the invoice terms provided (typically, any remaining balance after the deposit is payable upon completion of the service). We accept approved payment methods as indicated on our website or communicated during booking (such as credit card, e-transfer, or other forms of electronic payment). All prices are in Canadian dollars and may be subject to applicable taxes as required by law.
Cancellation Policy: If you need to cancel or reschedule a booked service, please notify us as soon as possible. Our cancellation terms are as follows:
- Cancellations within 24 hours of the scheduled service time: Such late cancellations will incur a cancellation fee of up to 100% of the service cost. In practice, this means the initial deposit you paid will be forfeited. MRCPro reserves the right to charge the remaining balance of the service fee to reach 100% of the agreed cost as a cancellation charge due to short notice.
Cancellations 48 hours or more in advance: If you cancel at least two (2) full days before your scheduled service, you will be eligible for a full refund of your deposit, and no additional cancellation fee will apply. - Cancellations between 24 and 48 hours in advance: For cancellations made on short notice but more than 24 hours ahead of the appointment, a partial cancellation fee may apply. Typically, MRCPro will retain 50% of the deposit to cover the late change, and the remaining portion of your deposit (if any) may be refunded. We will inform you of any such charges at the time of cancellation.
No-Show or Inaccessibility: If our crew arrives at the scheduled time and is unable to perform the service due to the client’s absence, inability to access the premises, or conditions at the site (including unsafe or hazardous conditions) that were not disclosed in advance, it will be treated as a cancellation without adequate notice. In such cases, the same policy as a cancellation within 24 hours may apply (up to a full service charge and/or forfeiture of the deposit) to compensate for the reserved time and resources.
Refunds: Any eligible refunds of deposits or prepayments will be processed via the original payment method within a reasonable timeframe. Please note that it may take several business days for a refund to appear on your account, depending on your financial institution.
5. Liability & Disclaimers
MRCPro strives to provide high-quality cleaning and maintenance services with due care and professionalism. However, by using our services, you acknowledge and agree to the following terms regarding liabilities and disclaimers:
Standard of Service: We will perform the agreed services in a careful and competent manner. If you have any issues with the service provided, you should inform us promptly so we can address the situation. We may, at our discretion, offer to re-clean or correct any issues directly related to our work, provided we are notified of the problem within a reasonable time frame after service.
Limited Liability for Damages: MRCPro is not responsible for damages or losses that fall beyond the scope of standard cleaning and maintenance. This includes, for example:
- Pre-existing conditions or damage that was already present at the property before we began work.
- Normal wear and tear or the natural results of cleaning (for example, paint chipping on an older surface during cleaning, or similar outcomes when a surface or item is in fragile condition).
- Any damage resulting from misinformation or lack of disclosure by the client regarding the property or items to be serviced (for example, if a piece of furniture is already unstable or a surface is prone to damage and this was not communicated to us).
- MRCPro is also not liable for any indirect, incidental, or consequential damages, including loss of profit, loss of revenue, loss of data, or any non-material damages arising from the performance of our services.
Maximum Liability: To the fullest extent permitted by law, the maximum aggregate liability of MRCPro (and its owners, directors, employees, and agents) to a client for any and all claims arising out of or related to our services or these Terms shall not exceed the total amount the client paid to MRCPro for the specific service in question. This limitation applies to all claims, whether based on contract, tort (including negligence), strict liability, or any other legal theory.
Subcontractors: In some cases, MRCPro may use vetted third-party subcontractors or partners to fulfill certain services or portions of the work. Any subcontractor engaged by MRCPro is required to carry their own liability insurance and to perform work to our quality standards under their agreement with us.
While MRCPro will make reasonable efforts to ensure subcontractors are qualified and reliable, MRCPro is not responsible for the acts, omissions, or negligence of subcontractors beyond our contractual obligations. If a subcontractor is involved in your service, any liability for their actions rests with that subcontractor and their insurance coverage, except to the extent that Quebec or Canadian law imposes non-delegable duties on MRCPro. We will, however, work with you to address any issues caused by a subcontractor within the scope of the service agreement.
Indemnification: You agree to indemnify and hold harmless MRCPro, its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the website or services, your violation of these Terms, or your violation of any law or the rights of any third party.
6. Privacy and Data Protection
Your privacy is important to us. MRCPro collects and uses personal information submitted through our website or during the service booking process (such as your name, address, contact information, and details about your requested services) for the purpose of providing quotes, scheduling and delivering services, processing payments, and communicating with you about your appointments or our offerings.
Consent to Data Collection: By providing your personal information to MRCPro (whether through our website forms, by email, or over the phone), you consent to the collection, use, and disclosure of that information in accordance with our Privacy Policy and applicable privacy laws. We handle personal data in compliance with the laws of Quebec and Canada, including the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.
Use of Information: Personal information we collect will be used strictly for legitimate business purposes, such as responding to inquiries, providing the services you requested, maintaining records, and improving our services. We do not sell or rent your personal information to third parties. We may share your information with third parties only as necessary to carry out our services or as required by law – for example, providing your address to a subcontractor or employee assigned to your cleaning, or using a third-party payment processor to handle credit card transactions – and always in accordance with privacy regulations.
Privacy Policy: Additional details about how we collect, use, protect, and disclose personal information are outlined in our Privacy Policy, which is hereby incorporated by reference into these Terms. Our Privacy Policy is available on our website (or provided to you by other means if required by law). We encourage you to read it for a comprehensive understanding of how MRCPro manages personal data. If any provision in these Terms conflicts with the Privacy Policy with respect to personal information, the terms of the Privacy Policy will prevail to the extent of that conflict.
Cookies and Website Usage: Our website may use “cookies” or similar tracking technologies to enhance user experience, analyze website traffic, and for security purposes. By using the website, you agree to our use of cookies as described in our Privacy Policy or cookie notification. You can adjust your browser settings to refuse cookies or alert you when cookies are being used, but note that some parts of the website might not function properly as a result.
7. Intellectual Property
All content and materials on the MRCPro website, including but not limited to the company name and logo, text, graphics, images, videos, layout/design elements, and software, are the intellectual property of MRCPro or are included with permission of the rights holders. These materials are protected by copyright, trademark, and other intellectual property laws in Canada and internationally.
MRCPro Branding: “MRCPro” and associated logos, slogans, or product and service names are trademarks (or trade names) owned by MRCPro. You are not permitted to use any of MRCPro’s trademarks, logos, or branding without our prior written consent. All rights are expressly reserved.
Website Content Use: As a visitor or user of our website, you are granted a limited, non-exclusive, and revocable license to access and view the content for your personal use or for legitimate business purposes related to our services. You may not otherwise copy, reproduce, distribute, publicly display, or create derivative works from our website content without explicit permission from MRCPro, except as allowed under applicable law (such as making a temporary copy in your computer’s cache or as permitted under fair dealing/fair use principles).
Prohibited Actions: Any unauthorized use of the website and its content is prohibited and may violate intellectual property or other laws. This includes the use of any data mining tools, robots, or similar data-gathering and extraction tools on our website content, which is strictly forbidden. You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of MRCPro without our express written consent.
Third-Party Content: If our website contains content, images, or links provided by third parties (for example, client testimonials, partner logos, or social media feeds), such content is the property of the respective third-party owners. Your use of any third-party materials may be subject to the terms established by those third parties. MRCPro’s display of third-party content or links on the website is not an endorsement and does not grant you any license or rights to that content beyond what is provided by law.
8. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of your use of the website or our services, shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein. This governing law applies regardless of your location, and without regard to conflict of laws principles.
By using the MRCPro website or services, you agree that any disputes arising under these Terms (or related to your use of the site or services) shall be brought in the courts of the Province of Quebec, Canada. You expressly consent to the exclusive jurisdiction of the courts in Quebec and waive any objections to such jurisdiction or venue, provided that if you are a consumer residing outside Quebec, you may have additional rights or options under consumer protection laws.
Severability: If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Entire Agreement: These Terms (together with any service agreements, work orders, or policies expressly incorporated herein, such as the Privacy Policy) constitute the entire agreement between you and MRCPro concerning your use of our website and services, and supersede any prior agreements, negotiations, or communications (whether oral or written) between you and us with respect to the subject matter.
